Defection simply means joining one party to another. According to the constitution, the following conditions are included in India -
An MLA being elected on a party ticket, leaving him and joining any other party. Contribution of MLA against his party's policy on fundamental principles. MLA remains independent after leaving a party. But this rule will not apply if you are expelled from the party. If we consider all the situations, then the situation of defection occurs when the MPs or MLAs of any party leave the party of their own free will or disobey the party whip. In this situation, his membership can be terminated and the anti-defection law will apply to him.
But if two-thirds of the MPs or MLAs of a party (earlier this number was one-third) leave the party, then this law will not apply to them, but they are not allowed to form their own independent party, they can join any other party. .
A famous jumla is used for defection which is as follows Aya Ram Gaya Ram / दल-बदल का साधारण अर्थ एक-दल से दूसरे दल में सम्मिलित होना हैं। संविधान के अनुसार भारत में निम्नलिखित स्थितियाँ सम्मिलित हैं -
किसी विधायक का किसी दल के टिकट पर निर्वाचित होकर उसे छोड़ देना और अन्य किसी दल में शामिल हो जाना। मौलिक सिध्दान्तों पर विधायक का अपनी पार्टी की नीति के विरुध्द योगदान करना। किसी दल को छोड़ने के बाद विधायक का निर्दलीय रहना। परन्तु पार्टी से निष्कासित किए जाने पर यह नियम लागू नहीं होगा। सारी स्थितियों पर यदि विचार करें तो दल बदल की स्थिति तब होती है जब किसी भी दल के सांसद या विधायक अपनी मर्जी से पार्टी छोड़ते हैं या पार्टी व्हिप की अवहेलना करते हैं। इस स्थिति में उनकी सदस्यता को समाप्त किया जा सकता है और उनपर दल बदल निरोधक कानून लागू होगा।
पर यदि किसी पार्टी के एक साथ दो तिहाई सांसद या विधायक (पहले ये संख्या एक तिहाई थी) पार्टी छोड़ते हैं तो उन पर ये कानून लागू नहीं होगा पर उन्हें अपना स्वतन्त्र दल बनाने की अनुमति नहीं है वो किसी दूसरे दल में शामिल हो सकते हैं।
