Explanation / व्याख्या :-

As per the Trade Unions (Amendment) Act, 2001, no trade union of workmen shall be registered unless at least 10% or 100, whichever is less, subject to a minimum of 7 workmen engaged or employed in the establishment or industry with which it is connected are the members of such trade union on the date of making of application for registration. It also states that a registered trade union of workmen shall at all times continue to have not less than 10% or 100 of the workmen, whichever is less, subject to a minimum of 7 persons engaged or employed in the establishment or industry with which it is connected, as its members. So the minimum member required to start a trade union is 7, the only condition is they must have same problem in common. / ट्रेड यूनियन (संशोधन) अधिनियम, 2001 के अनुसार, कामगारों का कोई भी ट्रेड यूनियन तब तक पंजीकृत नहीं किया जाएगा जब तक कि कम से कम 10% या 100, जो भी कम हो, उस प्रतिष्ठान या उद्योग में लगे या नियोजित न्यूनतम 7 कामगारों के अधीन, जिसके साथ वह पंजीकरण के लिए आवेदन करने की तारीख को ऐसे ट्रेड यूनियन के सदस्य जुड़े हुए हैं। इसमें यह भी कहा गया है कि कामगारों के एक पंजीकृत ट्रेड यूनियन में हर समय कम से कम 10% या 100 से कम कामगार बने रहेंगे, जो भी कम हो, कम से कम 7 व्यक्ति उस प्रतिष्ठान या उद्योग में लगे हों या कार्यरत हों, जिसके साथ वह काम करता है। इसके सदस्यों के रूप में जुड़ा हुआ है। तो ट्रेड यूनियन शुरू करने के लिए आवश्यक न्यूनतम सदस्य 7 है, केवल शर्त यह है कि उनमें समान समस्या होनी चाहिए।
