Explanation / व्याख्या :-

A judge of the Supreme Court can be removed by the President from his position only on the ground of proved misbehaviour or incapacity if a resolution in this regard is passed by the Parliament supported by two-thirds of the members present and voting in each Hose and the majority of the total membership of each House. The President may remove a judge of a High Court on the ground of “proved misbehaviour” or “incapacity.” / सर्वोच्च न्यायालय के किसी न्यायाधीश को राष्ट्रपति द्वारा उसके पद से केवल साबित कदाचार या अक्षमता के आधार पर हटाया जा सकता है यदि इस संबंध में संसद द्वारा प्रत्येक सदन में उपस्थित और मतदान करने वाले दो-तिहाई सदस्यों द्वारा समर्थित प्रस्ताव पारित किया जाता है और प्रत्येक सदन की कुल सदस्यता का बहुमत। राष्ट्रपति किसी उच्च न्यायालय के न्यायाधीश को “साबित कदाचार” या “अक्षमता” के आधार पर हटा सकता है।
